Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.
2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?
I have good credential to meet EB1.

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

My story:
In my 2 work exp.letters submitted to CIS, I break down the number of months I was working with company A with 2 different positions and stated my duties & responsibilities. I started as an electrical technician from 06/'07 - 01/'98 (7mos.) and move to Sales Engineer position from 02/'98 - 09/'98 (7mos.) so that a total of 14 mos. CIS only counted the electrical technician experience since my labor application position is electrical technician. However, the position of sales engineer, also entails the work of an electrical technician. meaning sales works is an added duties for the technicain job.
Moreover, my second letter, company B with a job title of Technical Trainee was totally disregarded. Where in fact, my work is actualy training a would be
"electrical technician". Now I just need to find ways to justify that to CIS. I dont know how to start though...could anybody help me here????

Hi, this might not be the right forum for my question but at least I am hoping that I can either can an answer or steered to the correct direction. So I quit my job in the US about a month ago because I was immigrating to another country. My job was located in Arizona and I immigrated to Israel. My company knew this was the reason I was quitting. So I am wondering if I should have received a severance package or unemployment benefits because of the reason of immigrating to another country.

Thanks for maintaining excellent site and answering all sorts of different complex questions.
Now my story.
I am going to apply in next H1B quota and was having below queries:
1. I am confuse about what kind of h1b interview questions will be ask by consulate officer
2. Will they ask my previous work experience letter.. because currently I am in Australia and my work experience was in India and there's no way I can have letter now.
3. How's the job market for Enterprise Oracle DBA
4. And Do I need to keep any extra precautions from start in order to be safe from all future legal problems being a consultant.

Hi Everyone
Looking for advice on my case -
We (I and my wife) filed for 485/EAD/AP on July 27 2007. We received all documents (receipt#, AP, FP etc) except EAD for my wife. The case status online shows her EAD application was received and pending. So on Jan 24th we put a Service Request for her EAD application. Yesterday we received a letter from USCIS with the following information --
The status ofthis service request is:
WAC-XX-XXX-XXXXX
Your 1-765 application was administratively closed on 0112912008.
If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.
If anyone has similar experience or know why they would close a case without giving any information or RFE/NOID etc? I tried calling them but the IO couldn't provide any further info.

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation. This story really makes me happy. I just wrapped up a dozen years of service on the board of the Hebrew Immigrant Aid Society, the organization that helped my family and my wife's family immigrate to the US. I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.
