I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

can you please tell me whether I-94 expiry date should be taken from I-94 CARD given at the port of entry or I-94 from H1b Extension approval notice when filling up I-485 Form?

My am in eb-3 category with a PD jan 2007.
I applied my i-485 to NSC and it was transferred to NBC in 2009.
NBC arranged an interview with the local immigration office in April 2009.
The Immigration Offer issued a welcome notice even though my PD was not current.
I still have not received the GREEN CARD.
In March of 2011 I received an email saying that my case has been transferred to TSC "to speed up processing"
So I dont know if this is a good thing or a bad thing.
Please respond.
FYI: I have NOT changed my Job, my employer or my address.

I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?

I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

My GC was started by a company A with priority date of June 2004 in EB3. 140 was approved and filed 485 in July 2007 when all gates opened. In parallel, a friend of mine started my GC processing under EB2. That has a priority date of March'2005. Current date for EB2 is Feb.2005.
I got an offer from a different company (company B), which I would like to take if I have no issues with GC etc. I am thinking what should be my plan of action. I have the following options:
1. Join company B on contract to hire on EAD that I got from company A as an employee of my friend's company. Apply 485 when EB2 becomes current for March 2005. Hopefully I will get my GC in an year and I join company B.
2. Join company B on EAD (or H1) and ask them to re-start my GC process under EB2. Issue with this is it may take a long time for my GC as PERM is taking longer nowaways.

Since her is the derivative GC and you are already approved there are no employment letters needed.
She needs to use AP/EAD to travel/work maintain legal status at all times.
You just need to be financially solvent just in case they ask for financial support docs I dont see that happening.
If your PD is EB3/2003 i dont think she will have to wait too long.
Too many people with PD 2001-2003 along with several 2004-2005 are approved or getting approval. anyone with Pd 2003 and above should not have to wait too long.

With July bulletin my PD becomes current I am ready to file AOS to my dependent. Offcourse not sure that once I submitted to attorney how soon he will send to USCIS.

My I-485 is pending(EB-3,India)since 2007. I changed employer & successfully ported PD on new I-140 approval in EB-2 category. My PD is in Oct 2006 & I expect that to become current in the coming few months.
Now, I need to do Interfiling to link my pending I-485 to my new I-140.
(1) What all documents/wordings are required for interfiling? Can someone pls provide a checklist?
(2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?
(3) Can I send my Interfiling request to USCIS even before my PD becomes current?

not even close to chronological order ... i know someone hwo applied in sept to nebraska got it ...
also check for numerous sept and even a few Oct approvals.
We are scheduled for infopass ...will see how that goes.
