Hi All
I know a lot of July 2nd filers and some other who have been waiting for receipt notices...
There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....
So everybody who is frustrated ..hang in there..have patience
Good luck ...
10/11/2007: July VB Fiasco I-485 Receipting Delays
The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

Thanks,
I also asked my company lawyer and they are suggesting that since her status is H4 she can not work. For working on EAD she has to leave country and reenter on AP.
So a little confused here?

Thank you for replying. One more follow up question: Is acting without pay considered work and hence a violation ? Thanks in advance.

Does anyone know what email / letter(s) one should get when the GC is approved ?
I received this email two days ago:
On November 13, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours.
Does this constitute as a GC approval ?
I read in other threads that a "card ordered" email follows the GC approval but I haven't received the email (nor the physical card yet).
Does it normally take 1 or more weeks for the physical card to arrive after approval ?
Thank you for any insight you can provide.

My attorney by mistake has applied for my ead renewal 10 days before the 120 time frame. I was supposed to send my application to USCIS by June 20th but my attorney sent it today and did this by mistake. can the gurus please explain me my options. i would hate to miss the line for being diligent. do they reject my application and if so will they send it back. can i apply a new app before i get this application back or do i have to wait till it comes back (if it comes back). what other negative implications should i be worried about.
thanks for your advice

Guys,
I'm in kind of a tricky situation.
I currently work for a consulting company who is sponsoring my GC.Our client has offered me a full time position and I was planning to use AC21 to switch over but better sense prevailed over me to continue with my current employer to avoid any issues in GC processing. Now my client is not willing to extend my contract.Given the current job market, I think it might take atleast a month or two for my employer to find me another project.
Just in case my I485 gets approved, can anyone please let me know if it is ok to be without pay (employer will not pay between projects) after the GC gets approved? Please advise.
Thanks.
Yes it is ok. If 485 is approved. Just dont use the unemployment benefit if you want to be a citizen. Btw, whats your EB category and PD?

No need for exp certificate in applying for H1.
At embassy/consulate, for visa stamping, you should keep it as they may like to verify. It is not mandatory but good to have.

Hi Folks.
Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.
I am sure there are folks here who went through this.
$585 per MTR (ie principal, spouse, child all seperate) to USCIS. Lawyer fee depends on nature of MTR - usually AC21 MTRs are common and the LAWYER fee must be nominal ie in the $1000 per MTR range

Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent
guys please reply

The only think illegal is not deporting all the illegals who broke the law. If a country cannot have fait in its Govt to enforce the law and take care of all the people breaking the law then it is illegal.
So OBAMA wake up deport all the illegals and do the legal thing.

I have got this response from Congressional Liaison, when I asked them for Update on my case whether I have to wiat till Oct or not based on the recent update on visa bulletin.
They Sent me This Email:
Your I-485 received on 5/21/07 and the Southern Service Center(TSC) is working these types of applications filed 9/11/06. They received your biometrics from the ASC 6/13/07 and the case has been assigned to an Adjudicating Officer for review. But, by the processing times, you still has a little time to wait.
Couple of question: They received your biometrics from the ASC 6/13/07 : Is this mean my FBI and Name Check cleared : I did my FP on same day?
the case has been assigned to an Adjudicating Officer for review: Is this mean I am in the last stage of getting final decision?
Anyone ?

Please discuss this citizenship issues with other forums or good attorney, you will get good response from them. Man, you are talking about the next level, members in this forum are fighting long for getting their green card and discussing retrogression related issue only.

Hi,
My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.
Thanks
Apply for MTR it will give some time.
There is no grace period for stay. But any thing less then 180 of overstay is excused based upon your difficulties. But if you cross 180 days then you cannot enter US for three year. (Search for three year ban)
