    The Immigration and Nationality Act (Act) provides for the admission of different classes of nonimmigrants who are foreign nationals seeking temporary admission to the United States. The purpose of the nonimmigrant�s intended stay in the United States determines his or her proper nonimmigrant classification. To qualify, a child must be unmarried and under the age of 21.

    F-1 nonimmigrants, as defined in section 101(a)(15)(F) of the Act, are foreign students coming to the United States to pursue a full course of academic study in SEVP-approved schools. An F-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an F-1 student.

    M-1 nonimmigrants, as defined in section 101(a)(15)(M) of the Act, are foreign nationals pursuing a full course of study at an SEVP-approved vocational or other recognized nonacademic institution (other than in language training programs) in the United States. An M-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an M-1 student.

    SEVP is the DHS program that administers SEVIS. It ensures that government agencies have essential data related to nonimmigrant students and exchange visitors to preserve national security. SEVP provides approval and oversight to schools authorized to enroll F and M nonimmigrant students and gives guidance to both schools and students about the requirements for maintenance of their status.

    In most of the job boards, we see the following employment types:

    1. Full Time (this I understand :))
    2. Contract - Corp 2 Corp
    3. Contract - Independent
    4. Contract - W2
    5. Contract to Hire - Corp 2 Corp/W2/Independent.

    Can someone explain to me what these mean?

    What are the differences with taxation perspective?

    For someone on EAD, (for AC21), which employment type(s) are preferred?

    I am on H1-B, and about to apply for I140.
    My wife has recently got a F1 visa (and her H4 visa has been left valid).
    I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

    Your wife's H4 is no longer valid since she switched to F1. You cannot hold non-immigrant status in two different classification at the same time. However, I think it is okay and even expedient that you mention her in your I-140.

    Hi,

    I have a questions and recommendation request.

    Question first:

    -> I am currently on H1 B
    -> I have filled my 485 and have EAD with priority date Nov 17, 2006
    -> I am planning to change job now.
    -> Question is; should I file for H1 Xfer or just take my chances with EAD?

    The request is for an immigration attorney that can help my new employer file H1 Xfer and AC-21.

    The Kauffman Foundation has a report out ranking the "new economy" states. Their methodology "measures the extent to which state economies are knowledge-based, globalized, entrepreneurial, IT-driven and innovation-based � in other words, to what degree state economies� structures and operations match the ideal structure of the New Economy." The winners? Massachusetts, Washington, Maryland, New Jersey and Connecticut. The laggards? Mississippi, West Virginia, Arkansas, Alabama and Wyoming.

    I never really know what to make of reports like this, but one of the metrics is "immigration of knowledge workers," which really isn't under the control of individual states. Visa quotas are set by the federal government. But why? There are a lot of places where a national solution really is best, but that seems particularly untrue in immigration. Detroit, for instance, has a lot of empty houses, a lot of shuttered factories, and a lot of emigration. They could probably use a bunch of immigrants to occupy homes, buy things, and start businesses. Similarly, California has had a pretty good experience with letting highly skilled immigrants start tech firms in the Northern part of the state. Maybe they'd like to let even more of them in to do it. These graphs explain the potential appeal (click for a larger version):

    There are obvious difficulties with having a California visa that doesn't work in Oregon. But we have limited visas now -- think student visas, or temporary agricultural workers -- and we seem to get by all right. Another concern would be that certain states would be overtaken by xenophobia and basically shut off immigration, though Arizona suggests that you can do quite a lot to make immigrants miserable even without changing the number of available visas, and my hunch is that any state that went too far in this direction would face a tremendous outcry from its business community.

    Wow ! I am in exactly same situation. I talked to national service center and they said they will talk to only employer or attorney. I told attorney about it and they said, dont worry , there online status system is screwed up so just wait for decision snail mail.
    After seeing your mail, I am susoecting VSC cases are having issues with status search. so I would say that dont worry.

    The bassist was reeeeealy close to a bright yellow-ish light everytime it came on (hit his arm and bass) it blew everything all to hell. Not quite sure how to compensate for something like that so I started taking shots when that one light turned off.

    I was using a flash with a different band but from a distance. I wasn't too sure if it would bother them or not.

    I received RFE's on the AP application for myself and my wife in the last week of September. We received our Fingerprinting notices the following week. We had our Biometrics done on October 12th. As far as my experience goes, I do not think RFE on AP should adversely affect the receipt of fingerprinting appointment notices.

    Gurus,

    I just received my EAD now. Though I am a 485 july filer, applied for EAD only in January.

    My 6 th year H1 will come to end in Oct. Because 180 days since 485 filing is over, I want to use AC21 and change the Employer now, and I am thinking why to go again for H1. I have the EAD, and why not use it, though I will be joining another desi employer.
    Does it seem the right thing to do? But everyine else I know changing the employer but again going for H1. Then why at all we have EAD.

    I understand that if GC is rejected, and if we are on H1, we don't have to leave. But if GC is rejected, I really don't care. Even if I get the GC, I want to go to Mera Bharath Mahaan.

    1. What are your thoughts on this?

    2. One thing I am still not clear on is: If EAD renewal is delayed next year, and if I don't receive the approval in time (i.e. before the expiry of my current EAD) will I be out of status because no H1 and no EAD?

    3. I am thinking there is no waiting period of 180 days etc from the EAD approval date to join another employer. Please correct me if this wrong.

    4. If I use EAD, what is the status of my family without H4?

    If the position you are being sponsored is 50% or more different than the position under which you have gained your experience, then experience gained in the same company can be counted. Your attorney somehow has to show that the postion you have now is more than 50% different (duties etc) than the new one. This is a tricky one and you would need a GOOOOOOD attorney to do that.

    Hi company A applied for my H1 in april 1st week.
    they have got 2 rfe so far and now i am not interested in working with them(they also dont seem interested in replying to the 2nd rfe)
    Another company is interested in filing my h1b.
    what is the safest way to go about doing this.
    should i let company B know that i filed with company A before.
    Also will there be any problem in getting H1b approved because of my earlier filing


    There should not be a problem in getting the H-1B approved by Co. B, assuming you and the position meet all the H-1B requirements. Just because there was a prior petition filed for you should not have a negative impact. You need to let Co. B know about the earlier filing, because there are some questions on the I-129 that might require them to provide information about the first filing.
