Yes - as long as your 485 is pending and you have a US address to receive the card.
So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?

I-140 Premium processing upgrade receipt number
Dear firends.,
My lawayer upgraded to premium processing for I-140 on June 20th,2007. Will I get a new receipt number or should I keep checking the status for the original I-140 receipt number

I'm in same boat, upgraded to PP on June 1. your new status of I140 will be "We received request for PP". usually they update the online status on friday night. Expect an RFE early next week, they just want more time, so they send some non-sense RFE. RFE resets the 15 day clock.

I assume you are planning on working in Canada using visitor visa. This is not legal and if you want to do it anyway, immigration authorities would question your intent of travel every monday to friday, when you have a valid H-1B work permit in USA. I don't think you will get by this.
My cousin had a similar experience he worked in Canada for two months on visitor visa, Immigration authorities were tough on him when he was on his way back to USA, asking him how come he had such a big vacation in a calendar year and also various other tough questions.
My advice is to apply for work permit in Canada through your existing companies branches in Canada and then work in Canada as you have suggested.
Please don't follow my advice blindly, contact your Attorney and look at all the legal ramifications and then decide about your future course of action.

Hello,
My labour got approved but we still have to file for I-140. My h1b is going to expire on May 2007.
Can I get H1b extension based on Labour approval? If not, is it necessary to file I-140 soon.

yes, if your labor was filed more than a year ago you can get an extension. However I would advice you to first only file 140. get it approved. these days it is fast. and then apply for h1b extension in january. you will be able to get 3 yr extn instead of 1 year. it will save you much extension headaches and legal fees.hope this helps.

Labor substitution is not an option anymore. I have PD Dec 2002 EB3 India working on EAD.
I am trying to pursue EB3 to EB2 porting. Risky but possible technically.
What is a probable timeline for Eb3 to Eb2 porting ? If we are already using EB3 EAD and not renewed old H1b, is it still possible to apply for Eb2 labor ?

First thing you need to understand is there is nothing called sponsoring a visa. You are basically saying that you will pay for their trip.
If they have enough fund, it is better if they say that they will pay for the trip themself.
As for other documents establishing ties, VO mostly does not ask for additional docs. They rely heavily on what is written in DS-160 and on the interview. If they have other children in India, it is best to carry a family photograph. Also, ask them to answer to the point ... who is in India, who is in US, what they do, etc.

Hi,
I am a july 21 filer and received I-485 notices on Sept 26. I am required to join my job on Oct 8 and i want to use the EAD for that.
My question is, if i see the status as "card ordered" before Oct 8, then can i call USCIS to get the EAD number before joining the job. OR does the employer need to be shown the EAD card before joining.
It looks like it is taking 1 week from notice date to see the status change to "Card Ordered" and another 7-10 days or more to get the card.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

Hello friends - the recd. date on my 765 application is August 7th...it's almost 90 days now (11/5 - next monday) that my application will be pending.!
Same is the case with AP..! No news at all for EAD & AP..Worried now!
Can i make a appt. with INFOPASS for both my EAD & AP together...? And what is the A # that they ask for when we fill Infopass appt.? Is it A # on 48 receipt notice.? OR A # on 140 approval notice.!
