While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

What is the reason behind you saying 'case may be audited' for the OP. Just curious to check your side of thoughts.
Per lawyer, almost all EB2 cases are being audited (due to the harsh economic climate). DOL believes that if a job falls under Job Zone 5, then it requires enough preparation to justify a EB2 filing. If it falls under Job Zone 4, it's not "normal" and DOL would usually require a Business necessity letter.

My second 140 may be approved by this month end.. Neb-Nov. 08-filing... i am hoping i will be able to port my PD..to 12-05
Now..in case i lose my job... and since i am in my 9th yr-h1..which expires may-2010..
suppose ..i cant find a job ...and if i have to leave US.....(but my employer agrees not to cancel my 140)

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

I switched my job in first week of October this year and My new employer filed the H1B transfer petition on Sep 26 (USCIS Receipt date). It has been almost two months and USCIS online status still shows case received and pending, while California State Center processing dates shown Oct 15 which is 20 days after Sep 26.
Is there anyone who has expereineced the same and want to share?
I am bit concerned because my employer has started the GC process and will be ready to submit the PERM application in few weeks.

Ajju, Mine & wife's applications for 485/EAD/AP reached Nebraska on 07/25/07 and I have receipt dates of 08/27/07. I'm yet to receive it from my lawyer. Found out the LIN #'s from the back of my encashed check. No finger print notice yet. I do not think every one who filed between 07/17/07 to 08/17/07 will have a receipt date of 07/17/07

8/27 should be your Notice Date... per online status it will say received on 8/27.. but its ND... Once you get physical receipts... the RD has to be 7/24 in all normal scenarios... But for July fiasco filers.. I think it could be just 7/17... Update once you get the physical receipts.. I may be wrong... just noticed this in one case only yet...

It usually takes 8 weeks tops to complete (after all dig deeeeeeeep checks). Does your first & last name match on passport, 797 and I-94? - this is one of reasons for delay in issuing a SSN. My 2C

I travelled on mine 3 months after it was issued ( delay in getting wife's visa). I was questioned at the airport about the delay in travel. Explained the delay and got entry. It may be possible that they may like to speak to your immediate boss (carry his office and cell numbers)

I think you should apply for H1 extensions about 6 months in advance even if u have applied for AOS. Your driver license might also expire with your H1-b and to renew your license you will need approved H1-Extension. Also just in case something goes wrong with your AOS application and it gets denied, you might be out of status.
I would strongly suggest that you apply for H1-Extension well in advance just to be on safe side.

I have been working for Company A which was bought under the Umbrella of a bigger parent. My company A still operates under the same name and is fairly independent.
The parent company bought another company B recently and have asked me move to B for business reasons in a similar role as with company A. Could I file a new GC with B and use my 10+ years experience with A to file for under EB2. I am currently under EB3-I category
