Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

I have a quick question. My I140 got approved in sep'08. Should I have to wait till PD gets current or I can file for I485 and USCIS will process my application according to my PD?
Any responce will be highly appreciated.

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

10/17/2007: Total of 60,000+ EB-485 Applications Adjudicated During July-August-September by NSC and TSC
* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Interesting.

What is the impact on GC (485 application) approval for a minor Customs violation at the airport?.
I unintentionally ignored to declare some food that i was bringing and airport customs officer fined me $300.
Will this impact my 485 application, that i will be filing soon?.
Ofcourse, i am going to mention in part 3 b.of application and provide the fine receipt.
Will my GC be denied because of this?.
Please advice.

This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

I have the following question reg. my wife's status.
1. i applied Green Card in EB3 category, i have my EAD but iam not using it and iam maintaining my H1b for my wife as she is in H4.
2. Meantime my company is processing EB2 for me and is in PERM stage and i have included my wife in the EB2 process.
Suppose if we apply a new H1b visa for my wife and because of the tough situation if that H1b petiton is denied for my wife, will there be any queries or any issues when my wife files I-485/EAD in EB2 . Also will it cause any serious delays or I-485/EAD might get rejected?

Other than name check are there any other stuff we should be aware of to get the green card.
With this new 180 day rule can I get my GC even if my Namecheck is not complete in 180 days. Is so once my PD is current and my 485 application has crossed the processing times can i go ahead and demand (please note demand) my green card or should i just leave it to luck and keep waiting hoping i will get it soon. sorry for sounding so sorrowful but the process seems to be very happazard.

Hello,
I have a RFE for my 485 according to the online status. My PD is current, and NSC's 485 processing time is now July 19, 07. My 485 RD was July 25, 07, so it is likely that they are working on adjudicating my case (and could have approved if there were no RFE).
I am still waiting for the RFE in the mail to know what it is exactly. But, assume that I fulfill their request and mail them the required items immediately, will I need to wait another 6 months before they check my RFE fulfillment? Or do they usually look at the RFE immediately (since they are already working on my case)...
