Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

yes still labor transfer is possible ..But you have to very carefull.. you need to find what was companys financial position at that time when labor was filled. wheather you were fullfiling your experience as required in Labor at that time... and you need to check the companys situation if it is not blaclisted by DOL.

Well I have been waiting for a reply, seems like no one has answered my question. Can someone please post some suggestions. urgent
You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.
You can file for a fresh H1 visa in Master's quota under consular processing and when its approved, attend the Visa interview, get a new H1 stamp, and re-enter using the fresh stamp. This way, you will get fresh 6 yrs time on H1.

Hello I recently purchased a Nikon D70 to use for concert photography. I was using a Sony Mavica CD-250 but it wasn't cutting it for the larger shows where no flash could be used. I just did my first show where flash could not be used and the pictures came out so-so. I have 2 lenses a Nikkor AF 28-80mm and a Nikkor AF 70-300mm. I have full access to photo pits in front of the stage and am wondering what the best settings are for the D70 in these conditions to ensure at least some of the photos will come out decent.

Hi,
is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:
Has any1 wth the same situation has gone and come back without any issues?
Gurus ur input s greatly appreciated.

you can use OCT 02 EB3, file I-140, after it is approved you can port the Oct 02 PD for the EB2 application too. This way you will be current as soon as I-140 is approved, guaranteeed.

Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?
