11/01/2007: House Agreed to H.R. 3043 Labor-HHS FY 2008 Conference Request of the Senate and Appointed House Conferees Yesterday
The House appointed the following members of the House of Representatives to the Senate-House Conference Committee for this legislation: Representatives Obey, Lowey, DeLauro, Jackson (IL), Kennedy, Roybal-Allard, Lee, Udall (NM), Honda, McCollum (MN), Ryan (OH), Murtha, Edwards, Walsh (NY), Regula, Peterson (PA), Weldon (FL), Simpson, Rehberg, Young (FL), Wicker, and Lewis (CA).
The list of the full conference committee: On the House side, Representatives Obey, Lowey, DeLauro, Jackson (IL), Kennedy, Roybal-Allard, Lee, Udall (NM), Honda, McCollum (MN), Ryan (OH), Murtha, Edwards, Walsh (NY), Regula, Peterson (PA), Weldon (FL), Simpson, Rehberg, Young (FL), Wicker, and Lewis (CA). Now, since the immigrant community has the full list of the members of the Senate-House conference committee, they should actively contact the members of the conference committee to support EB-3 visa number recapture bill and to oppose the H-1B supplemental fee legislation, at least to see that the former immigration bill is agreed to and the latter immigration bill is rejected at the level of conference process within the Congress. TIME IS RUNNING OUT!!! :confused:

If we have to open one more office elsewhere, do you think there are any specific requireemnts the office space must meet.
Like sq footage, cabins.. etc. Do you have any link that talks about office space wrt immigration requirements,
I am not an employer, but I got a project to look for space and this is considered important as its related to immigration requirements.

Can someone please explain why copies of the passport (showing biographical data) are required? Which form asks for them - I did not find anything in I-485. That form only asks for a copy of the visa, if issued within the last year.

I believe you should be using your EAD + AC21 after 6 months of filing 485.
did you check elsewhere in the forum, I have seena lot of communication about it before here.

you can use AC21 with H1 transfer also. Using EAD is not mandatory.

Please advise:
I am on F-1 and working under CPT from Jan 07 to Aug. 07 and will extend CPT from Sept 07 to Dec. 07.
I applied I-485 and 765 (EAD) as a husband on my wife's LC on July 2, 2007.
I will not be getting my EAD before Sept. 07.
My confusion is whether is it legal to extend my CPT on F1 even if I receive AOS receipt number ??
you travel and try to re-enter US on F-1(PT) status this shouldn't be a problem. My understanding is F1 (non-immigrant intent) and pending 485 are incompatible for re-entry. Check with your lawyer.

Unfortunately , it is true. I personally know a friend whose I-485 was denied even without issuing any NOID or RFE. Reason, well its very obvious, the underlying I-140 was revoked, even though it was past 180 days. By law, your supposed to get NOID or RFE. but some IOs are ignorant and do not know the AC21 laws properly. So they issue straight denial. The number of cases are few because not many companies revoke I-140 past 180 days. But few companies do and some have to do it. So in these situation yes, chances are that you will get a straight denial and that is why there is thread to lobby efforts to raise some concerns to Ombudsman about these erroneous denials.

Please note that an I-485 approval invalidates the H-1B visa.

Even though your end client is not the direct client for your employer, they might have used the laguage in the non-compete which reflects the scenario. So check your non-compete document.
May be the final verdict is in favour, you need to take so much of pain in the whole processes. If you prepare for these upfront you can go a head and fight. I had seen couple of instances in the NY, with my friends, where non-compete became VOID.

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.

Has anyone been able to call USCIS premium processing toll free number today and talk to an Officer. I have been unable to get to an Officer today but was able to talk before. I am wondering whether there is a limit on how many times you can call(I have called 3 times so far in 10 days) or if you can't call after so many days have passed after your application is approved.

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

I want to keep this thread on top for a while to see how many People with priority date between Jan'05 and March 28th '05(Filed under RIR/NON-RIR) applied again in PERM. The reason is lot of Friends i know applied their labor again in PERM since the Old Labors filed under RIR were sent to BEC Center's in Phily and Dallas for 'cold storage' and forgot to port the dates after the old labor approval since the time regained was not big enough.
This gives us an fairly good idea to see how quickly the dates would move from Jan' 22nd '05 as many fear there might a huge figure here who applied between December '04 and March 28th '05 under the old process and before PERM kicked in .
Please do not forget to mention if you have ported the dates from your old labor.
