Quick question; so when was your EB3 140 approved? or does it really have to be approved inorder to port to the EB2?
Can a person who only has labor approved under EB3 later port to that date if he were to get the labor approved under EB2?
My EB-3 I-140 was approved in March 2007. Yes, you need to have an approved I-140 to port your PD. Just an approved labor with earlier PD won't help.

To all EB3 members whose PD is current:
Monday is the last day. If you don't get your GC approved, you got to wait for at least 7/8 months before they start moving dates forward. Beginning of each fiscal year, the dates are generally very conservative.
And for ROW EB3, if the bill passes to eliminate country quota, you will be getting your GC in not less than 5 years from now which you could have get it if your f**ing attorney/company would have file it 7 days earlier! Big time screwed! I am one of them!

Not true - a small apt is a small apt no matter what. Yes, you can live with peace of mind in a small apt, and yes you can live happily in a small apt. This does not equate to quality of life. The "quality of life" in a 4 bedroom house with back yard is greater than that in a small 650 sq ft single bedroom apt ( if you put the same person who was happy in the small apt into the 4 bedroom house - even if his happiness level remains the same, his quality of life just went up)
Nothing against someone buying a 4BR house. I respect everyone's decision to buy whatever they can afford. I had been to one of my friend's 4BR home in North East during winter and felt like being in a igloo. The heat was set at about 62 to save on heating cost!
I'd rather have a 2BR apartment (or a 3BR based on need) and have a comfortable temperature.
One can buy a home but ensure one doesn't become 'house poor'!

Hi,
My labor certification was filed in Dec. '06. Since its date of filing, the online case status was showing as "in process". However, on 07/20/07, last week, the status changed to "case denied".
1) What are the next steps?
2) Do I need to refile the labor certification. If yes, how soon can it be done?
3) Can it be filed for the same position or it needs to be filed for a different position?
4) Should I find a new employer to file for labor certification as my current employer could not get my labor certification approved or I should stick with this employer itself and file for a new labor certification?
Please help me out.

Sorry to hear about your bad luck. It really depends on why the case was denied. Your best bet would be to talk to your attorney to find out why it was rejected. Depending on the reason, the attorney can file an appeal.

I dont know but even the smallest of consulting companies dont make this kind of mistake and they would remind you if you forget. My company's lawyer is quite lazy and slow but even his paralegal asked all the right questions and got all documents needed and didnt forget stuff when filing for various things.

They never asked for my wife's I-94 till the 11th hour when I brought the fact that I'm married and my wife (no wives here :( ) might need some extension. Since, it was my first H1 extension after marriage, I really didn't know that company has to file for her extension as well. I thought it just happens automatically..how naive I was.

Till now, I was thinking that I will get my EAD any time soon but looks like, I am stuck. Today is 63rd day and I have no news. I e-filed on 06/02. Is there anything, I can do to expedite it ? My wife paper filed on 06/15 and she also has no news. We both filed with TSC.

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

We are on the same boat. I'm wondering if there are any successful cases where CSPA and the Patriot Act were combined to ensure that the child remains under 21? My son's name has been deleted from the derivative beneficiary's list, however, he can remain eligible under this I-130 F-4 petition if the Consular calculate his age with Patriot Act 45 days. In that case, he can benefit from CSPA. Our case details as below:
Priority Date: Oct. 16, 1996
Approval Date: Dec. 4, 1996
Days of Petition Pending: 49 days
Child's 21st Birthday: May 31, 2007
Child's age when visa became current: 21 years 62 days

It all depends on what country you are a citizen of. If you are a passport holder of a country like Canada,Autralia or most european countries, then you may not see much benefit in holding a US passport when travelling. But people from certain other countries, have to go through the hassle of obtaining visas prior to international travel, vacations etc. Sometimes we even have to get transit visas for countries that we pass through on our way to the final destinations. And these visas cost money. But if you hold a US passport/citizen of the US, then they do not make you jump through all those hoops. You board the plane and you get a visitors visa once you land in almost all countries (there are exceptions, India and Australia for example). But there it is. That is one of the priviledges of having a US passport.

There are too many assumptions here. How I see this situation is;
EB3 I will not move significantly unless and until oversubscribed EB2s become current. Even then, it cannot be taken as granted because the demand of EB2s can take all the spill over and be current without spilling to EB3. USCIS will eventually make the change once they see that EB3 has significant retrogression and there is a lot of noise made about it.
The solution I see is; we can make a valid presentation showing the effects of this spillover change in the long run and how EB3s will be affected seriously.
If DOS continues with this interpretation of spillover then there is a very small (tiny) window coming up in third quarter of FY 2010 (Apr'2010) where we might see some spillover to EB3. Here is how:
Currently there are total 4050 (EB1) + 74932 (EB2) = 78982. These are mostly pre-adjudicated and waiting for VISA numbers.
Total allocation for new FY is 140K out of which 40K (28.6%) will go to EB3. So EB1 and EB2 will have 100K left but their total demand is only 78982. So these 21K numbers will be left which will be used for new applications recieved under EB2 category.
When PD for EB2-I/C moves forward, there will be more applications coming in because many EB2-I/C people have their labor approved and they are waiting to file their I-485. However, when these new applications comes in, they are NOT processed yet and their background check is not clear yet. So even if visa numbers are available for them, they are not ready to be approved.
So at this time we poor EB3 people can hope some mercy from DOS and we hope that DOS might spill those remaining 21K numbers to EB3 so we don't waste any numbers while USCIS is adjudicating those newly recd applications under EB2.
If this 21K spillover happens then we EB3-I have to hope for another mercy from DOS that they give these 21K spillover numbers strictly based on Priority dates in EB3 and not based on EB3-ROW first and then EB3-C and then EB3-M/P and then EB3-I. We expect DOS to give these spillover based on PD and not based on country of chargeability. If that happens then all these numbers will go to EB3-I and we might see it moving to 2003.
And this is a fair expectation from DOS that they give spillover numbers based on PD because that is what they are doing in EB2-. When EB2-ROW numbers goes to EB2-I and EB2-C they go based on PD and hence EB2-I gets most of the numbers.

I really see no problem with his/her post, he was just asking the IV community if his issue can be addressed or not. Its up to the community as a whole to decide what to do with it.

Finally...I just got an e-mail notification that my 485 application was approved. It has been 11 year long journey.
I was a donor member for 2.5 yrs, was a member of advocacy day for the last two years. Thanks to IV for all the help especially during the last year EAD expedite process. Good luck to everyone.
