My wife who is on H-4 is planning to go to India in December this year and would need to appear at the chennai consulate for visa renewal. I am currently in my 7th year with my labor stuck in PBEC. I am due for my 8th year extension before April 2007 but am waiting to get my labor/I-140 so I could file for a 3 year extension.
My question/concern is about my wife's renewal. I keep hearing that ppl are facing issues like name check/security issues for visa renewal. My good friend and a relative are stuck in india for 8/6 months respectively waiting for a H-1B visa issuance (Embassy's already charged the visa issuance fee but have not stamped the visa on both passport citing various reasons).
What issues should I be concerned about? My visa has expired this past april. Would the embassy insist for my visa renewal. Would be a issue that only three months remain in my wife's H-4 renewal papers? I would greatly appreciate if ppl could share their experiences to help through this unnerving process.

I am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.
1.What is manner of last entry and the current immigration status for her? Is it Parolee or H4 status in both cases?
2.I have filed I-485 after July 2007. Can I E-file? As I read somewhere on forum that On or after July 30, 2007, applications may not be electronically filed and must be submitted to a Service Center via regular mail or courier service.

I work for Company A from the year 2003 on H1-B Visa and here is my details
Priority Date : Aug 2004 (EB3-I)
I-140 Approved date : Jan 2007
I-485 Filed date : July 2007
Currently using : H1-B (8 th year running)

Now i got an offer from Company B but they can accept only EAD or GC with Good salary and position. I am really tired of getting low salary with company A as they started taking advantage of me.
Now if i use EAD card to move to company B (by using AC21) and once i get a green card (don't know when ??) do i have to come back to company A and work for one or two years as GC is for future employment ? Is there any rule like this ?
I am also planning to have my personal attorney after moving to Company B to take care of AC 21 and other communications.
I am not sure Company A will allow me to move at this stage and i cannot waste my life with this company for a low salary so i want to move and make some progress in my life.
Have any of you moved like this and got GC ? Will there be any issues ?
Please advise.

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.
Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?

I believe if employer move to next door i don't think DOL will ask yoru employer to refile, but if your employer move to a different city/town even in the same county, YES he need to start the process all over again.

What is the acceptable distance?. My office moved to a place near by my old office location to save rental expenses. Does that mean that I have to start all over again? this is insane. :confused:

In september my dates became current and my GC and my spouse GC has been approved . However my lawyer recieved interview notices for me and my wife. What should be the next step. Ignore the notices as we recieved the Green card or do we need to attend the interview.
My advice "do not ignore it". Best is to take an infopass and get it resolved. Else attend the interview. Take a local lawyer if you need and tell the officer that you already have a GC. It is better to personally close this issue than reklessly abandon it hoping that it will close by itself. It can create more mess than you can handle.

My H1 Extension approved from Sept'2010 - Dec 2012. LCA shows same dates and the salary shown is $5500 PM ($66000 P.A)
However recently, i noticed that i am receiving $5373(instead of $5500) per month since Sept'2010 till date.
I informed to my employer and he is willing to increase the pay from March.
Is it possible to correct it from March payroll.
Please advise.

With new DOL policies and increasing immigration and labor standards enforcement, approval rates for labor transfers are down drastically. AILA reports even approval rates for PERM are down to 62% from the 80% approval rates seen earlier. Be careful, and have another parallel 'regular' filing so in case your sub labor gets rejected you don't loose additional Piority Date time.

If you accept the employment with lower salary using AC-21 and if any RFE comes for Employment verification then you will not be able to respond to the satisafaction of USCIS on why you are working on the lower wages.
Hope this helps you understand the importance of keeping job position and slary level consistent with what its in your approved labor.
another option is to start the process all over again with lower salary, but with onging PERM/I-140 backlogs who wants to go thro' this hell again???
Bottomline stay with your consulting employer, why in the world you want to accept the lower salary???
You are EB-2 and the way dates are moving now for EB-2 you might get your GC soon....if the client is forcing you to come on board as PERM try to convince him that its a matter of another 5-6 months before you get GC and then you can accept his offer if you are looking for the job stability versus wokring for a consulting employer.

Option 1: you can get someone to take your photograph with a digital camera and then use Passport photos for free - ePassportPhoto.com (http://www.epassportphoto.com) to make sure that it is cropped to size and meets the size requirements. You will need to ensure that the picture is taken correctly though (without shadows, against a plain light background, etc.). You can get more details about the photo requirements from:

Option 2: You can also go to any place like Costco or Walgreens and have them take your picture and upload the scanned version of the picture.

Hi,
I have applied 485 through a lawyer. The lawfirm sold their company to some one else. I was asked to file G28 and I didn't file for G28 yet.
I got a mail saying I was sent RFE n Feb 4th. I haven't received the letter yet. Would the RFE go to lawyer or me?
What should I do now?
