I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.
In the last radio show that IV was invited (cannot recall which one), one of the premier companies had in fact opined that they will move the jobs overseas if the doors are not opened here. Most probably the company was Oracle.

Here is my situation and below are my question...
Entry to US - 08/14/2005
Petiton is valid till 06/17/2011 (and I have vacation time of 4 weeks).
Labor applied on EB2 category on 09/23/2010
EB2 labor Audit replied in June 2009.
H1B extension based on pending labor applied on 12/03/2010.
EB2 labor denied on -12/13/2010.
Question??
What will happen to my H1B extension? and what time it will get extended?or what action should we take?
Do I need to re-appeal the labor that has been denied ,apply for H1B extension and wait to get clear the 7th year extension (thruogh premium? from June 2011 to June 2012).
Can I apply for EB2 or EB3?(which would be best in my scenario, I think i still have time if 7th year H1B extension is approved).
Can we apply EB2 even after we appeal previous labor which is also on EB2 category ? or do we have to withdraw old EB2 labor and then re-apply again on EB2?
Please help me with the above questions and I really appreciate your help in this regard.

Extension = from the time requested = for example 4/1/2008 to...no more than 3 years. 3 years is the max time requested. So, if you company requests from 4/1/2008, it should state until 4/1/2011.

I am a computer science graduate from India ( 4 year engineering degree course) with 3 years experince in SAP. A reputed company in US has agreed to process H1 for me. They have only asked for my educational certificates. My experience certificates were not submitted since they said it is required only when you go for the H1B at the US Embassy.
My query is wheather experince certificates are required for applying H1B.

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)
No employer will write a direct agreement, you will have to payback the GC cost - instead they execute an agreement, employee should payback all the benefits (legal fees, service fee, tuition fee and etc)extended to him, if s/he leaves before X number of months/years - which is legal. Refer to one of the posts, http://immigrationvoice.org/forum/showpost.php?p=211373&postcount=3 , which has same opinion.
BTW, can you post the reference that states this kind of agreement is illegal - I would like to bookmark it, if one available.

You maintain H-1B status as long as there is a relationship between u and ur company. This is usually showed by paystubs. If you do not, you can apply for H-1B transfer, but then the extension of stay will most likely not be granted, as the USCIS needs to see your paystubs. I would speak to an attorney about this.

Yes you can do this...just call the embassy....Indian ambassy is pretty fast....to help on this...
