I thought there is no harder working organization than USCIS. The devotion they showed towards June end by working long weekend hours to approve 60K visas is commendable :)

All those who answered were right! You don't have to reapply H4 for your dependants when you change employers as long as their current status is still valid. I changed employers in 2004 and didn't have to apply new H4 for my family until 2006 when their previous status expired.
On another note, one does not need a new visa stamp in passport when one changes employers until current visa stamp expires.
I hope this puts your mind at rest. You may however want to confirm this with your lawyer and post his answer.

What about those "lucky" creatures who worked for a desi employer? Desi employer ALWAYS file EB2, regardless of wht the requirement is. It is only the legitimate companies that actually bother about the "requirement" to file an EB2.
Anyways, its a moot point to have this discussion, since its not helping anyone's cause.
its probably the other way around..... desi employers usually file in eb3 so that they can have a grip on their employee for longer period of time... other employers may sometime weigh in the merit of the application resulting in eb2......
btw, they r all legitimate companies.... there is no illegitimate company..... u may not like them..... that does not make them illegitimate..... u could ask guys at cisco, msft or any of the large companies..... they all luv working with tcs, infosys patni etc....

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.
It is not the policy of DOS or USCIS to follow horizontal or vertical spill over. It is law. Both federal agencies (DOS and USCIS) has to obey the law by strictly following what INA section 201, 202 and 203 says, irrespective of how the law is unfair to any catagory. The law is very clear about spillover; it is horizontal. One has to read word by word in the law book to understand how the allocation of EB visas are made.
If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always “current”. EB3 including ROW might have been much worst situation than now. EB3-IN would have beeen (always) be in disaster state since 2001. Though it is unfair to (EB3) many, this is what the law. Here is the historical events what happened in EB catagories.
In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 (100% not 7%) EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That’s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair to EB3) the law. Can you tell what reasons you had given for the Expedite Request?
I have told them that Im the only bread earner of the family and the cost of living in the area that i live is very high and that I have bills to pay. But they have denied my request. i dont know what other financial hardship should I show them. Maybe I should declare bankruptcy and then send that over to USCIS to show that I really have financial hardship.
I have infopass appointment on 14th I will try to raise the same issue again and see what they will say

I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.

DOL filed my application for perm.work permit on March 2006. /so my Pd march 2006/ They approved this application.Then ,we sent the i-140 application form to USCIS.They sent it back,because the DOL made an error concering my salary.The DOL corrected this error and approved once again in October 2006. Now my i-140 is approved,USCIS transfered my case to NVC and to my atthorney in which the priority date is October 2006.Now I waiting for CP .What can I do in this situation? You put too much stress on "quality of life". One can have a good quality of life in a small apartment.
I keep telling my wife that our apartment looks small only when she goes to department stores and shops like crazy. Our walk-in-closet is the nearest thing to a Black Hole. Mass density is so high in that area that pretty soon even light would not come out of it.
I strongly believe in "Simple Living, Hight Thinking". I can not say I implement it all the time, however, I try to keep it in my mind during my decision making process.

My daugther's date of birth is 03/18/1988. We filed I-485 together in 02,June 2007. We all recieved I-140 approval and I-485 receipt.
I would like to know whether my daughter will age out in 03/18/2009 or 03/18/2010?. She is working as RN ( 2 year degree) in hospital under EAD.
