Dear friend akred,
One question for you my friend, ask your consience.
your advice to BEG, Borrow, STEAL or KILL, is this how we should conduct ourself in the society. Do you want such kind of society. Is it good to profess anger, decit and violence in society. (think what our kids will face when they grow up.) ?
As a devote Hindu, I live by Hindu way of life, and I Hope you do too, I PRAY to you, can you PLEASE implement this way of life in your normal daily life, you will see the difference yourself.
Not meaning to anger you, Sorry in advance if I have hurt you. I pray you will change.

We all had a sigh of relief when we saw the new labor certification process (Perm) and were promised that it will be much faster and smooth. Thankfully they have kept their promise, for the most part, except for the cases that get audited.
The cases that are 'randomly audited' have been pending for months and months, some cases () have been pending for over an year and there have been no response from DoL what so ever. I understand that a year does not sound bad especially to those folks who had their labor approved through the old process but these days the labor is getting approved within 50-60 days (average). It appears that the DOL (Atlanta Processing Center at least) does not bother to look at the documents once the audit has been replied to.
Although I understand that not everyone uses and some audit replies may have been replied sooner and were never reported to but you can get the idea just by a sample of the cases that were audited, and see that they have being neglected, ignored or appears that they are no longer considered for further processing. I have seen instances where the lawyers have retreated the application in the audit and filed a new application (a gamble) hoping that it does not get audit this time around. But not sure how that turned out.
If you visit the Atlanta Perm section on you will see the people's misery I mention here. In fact, I am sure that there are number of IV members who are going through this aggravating process but are silent becuase they know that can not do anything. Even lawyers have shown the sign of disappointment to this hopeless condition.
So I ask you, Members of IV, to help us and suggest something that (we) can be done to bring this to the attention of some sort of authority that would help trigger the review of Audit responses.

As of now we are gathering people here to estimate how many people are out there suffering the delays caused by Perm Audit. I have added a poll which is a way for us to estimate the number of people who will support any action that we take to make our voice heard.

Similar to this, we need as many efforts as we can have.
To further continue this effort, I would suggest writing letters to your local congress rep & Senator, particularly those who have been waiting for over 5 years.
More effective approach will be to contact local media.
Since we have a unique situation, I would recommend start a request to separate legal employment based migrants from other categories.
BOTTOM LINE: We can not wait for CIR, this is NOT about comprehensive immigration reform, this is a requirement from current employment based immigration system.
Instead of writing a letter, why not start with a phone call. Find out a bit about the staff ahead of time (Google, Linkedin, etc.) and then call the person that is most likely to be helpful. Then ask for a meeting.

My wife's LC was filed through the old process. We also did the PERM for her and were able to port the old PD BUT it took almost a year and the lawyer told us he had to ask his 'congressional contact' for help.
PERM may be an option for people in BEC - but not a sure shot one. The whole process takes ~6 months (including advertisements) and you/your company need to shell out $$$.
I empathize with you - but this is life. I had a PD of Oct '03 - but got sick of my job and changed - so now have a PD of Dec '05. Didn't make a difference as both became current in the July VB.
All of us come here for different reasons - many like me come for career opportunities. When GC/visa issues become a barrier for your career, it's time to rethink - when at the same time the opportunities in your country are much better. In the grand scheme of things, it's still not clear how important a GC is - don't get me wrong it really really helps - but if you are unlucky - then you need to evaluate the opportunity cost.

As I mentioned on your previous thread too, I got laid off while on vacation in India, I have a mortgage and my wife is pregnant. And I bought my house long before I even started my GC process. Do I regret it? Absolutely not!
I live in an amazing high rise condo with fantastic views, I pretty much walk to everywhere even though I do own a car and live a pretty nice life. Despite that, I have decent savings. Would I have had more savings if I didnt have this condo? Sure, no doubt. But I didnt move to the US of A to live like a bhangi. I came here to live a life I couldnt possibly have back in India (and mind you I had a very good life back home too). Last year I learnt sailing and its a pretty expensive sport, but where else will you be able to sail if not here. This year I had planned to learn skiing, but given the fact that I am now laid off, maybe next year. I fully intend to fight too. If it means I take a substantial paycut, I will. If it means I need to do work that I used to do 4 years ago, fine. You gotta roll with the punches bro.
I am just grateful that the July fiasco happened and I have an EAD. I am grateful my wife still has a job. And above all I am grateful that I will soon be a father. Like my parents I fully intend to give my kid the best that I can afford. If s/he wants to goto Harvard, s/he will. I dont want my kid ever growing up believing that something is not possible. That is one thing I have learned from this November's election. This country's ability to embrace change is phenomenal and the generosity of its people is amazing.
I remember on 9/11, my manager came up to me and gave me a letter on the company's letterhead that stated that I was working there and he can be called on to vouch for my character at anytime. Rather naively, I asked him why I needed this and he said, "Keep it. I hope you never do, but just in case." I never forgot that gesture.

I think your calculation is wrong. If there are 8742 applications then it should take less than 3 years not 5 years. In the 2nd case for 14583 applications the wait would be around 5 years instead of 10-12 years. This is due to the fact that every year around 3000 visas go to EB3 category. Though this is a long wait too so either way we need legislative fix for all the cases.
For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.
For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.
Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.

Here is a scene I was in:
Paskal(Puneet) is driving - Sumita is sitting on the passenger seat - we have no idea where we are going. It is 2:00a.m and we are REALLY hungry and tired...
Sumita "I will give you directions from my Tom - Tom " I think she meant GPS.
Puneet (after taking several wrong turns) "It is not a Tom - Tom"?
Sumita- " whateverer it is , it gives me directions and I talk to it" (She was spending 4 hrs. driving each day with this TomTom ).
Puneet - "ok, let's follow our friends".
Sumita dials.
Vandana(in the other car) - "Yeah you can follow us".
Puneet - "well where are you guys"
Vandana - "We are trying to figure out, I don't know how we got here - Let me consult my GPS"
This is what happens when you are sleep deprived, food deprived - all the gadgets in the world cannot help you.

as for sumita (samay)...besides working very hard...she provided great entertainment...don't know what we would have done without her. i'm going to remember her waiving her car keys at me and asking me to drive and then even before the car moved...she announed "not so fast" , took you and me a moment to realize she was saying it to vijay on the phone not to poor me who had not yet moved!!!!! i will also not forget her walking upto the registration desk on rally day and someone said good morning...sending sumita into a real tizzy as her morning "had begun at 5 am" which is absolutely true...since she had one of aman's lost bags and was given no choice but to drive to VA to return it...
yeah and that "tom-tom"...wish she would learn to program it :D
(ok now we are guaranteed to get a response! if not let's make a lawyer joke!)
i was also in that other hilarious cab ride well after midnight on monday night when we were desprately trying to find our hotel. i will never ever forget logiclife's frustration sitting next to the driver who could neither read nor understand english and was deathly scared that if he went for directions we would ride away in his cab :D:D
that scene when logiclife finally grabbed the wheel on the highway to get us on the correct exit had me and pratik in splits the rest of the ride...and when he tried to get the cabbie to move as the other car we were following was leaving...tapped in on the shoulder..then head...finally his face as our guy seened utterly lost trying to read his zones and calculate how much fare we were building up in that wild ride...
add to that aman's lost bags and cell phone and constant attempts to call akhil to retrieve his wallet...poor akhil arrived back huffing and puffing and in mortal panic...later we discovered we had his home phone number and had been leaving messages on it for 2 days...and wondering why in the world he would not pick his phone up!
btw i persuaded jane to eat a samosa...she was very scared it would keep her up but the small size convinced her to try it...i think she even like it...:cool:

I agree with you but give them(EB3 people) hope that next year we will re capture unused visas either through CIR or piecemeal amendment.
With re-capture EB2 will be current and all the spillover/accross/up/down will go to EB3
and next year sept Eb3 will move 3-4 years.
I do not know much but IV core might be in a good position to answer about how we can
get our provisions piecemeal.
Unless if the law changes so that all these years of wait count towards citizenship, I sincerely think the wait is useless and its totally unfair.

This really is height of optimism......it seems that readers think that USCIS IOs were desperately waiting for dates to get current and start approving applications...reality is they don't care and never cared..they may start issuing more RFEs if anything...Again stay rooted to ground and don;t start floating in the clouds....especially with USCIS's fantastic track record.....

Please check with your immigration attroney as they know it better but here are few things i heard:
EAD+AP:
after 6 mths of I-485 filing, shifting jobs would be easy with EAD. costly because of yearly renewal but worth based on your situation. i prefer renewing this EAD+AP, even in H1 so that you can shift jobs when you got the oppurtunity because EAD takes 3-4 mths approval time and you can travel using AP like H1 when you dont have H1 stamping. Even if you have H1stamping but if you use EAD/AP while entering US then you are no longer in H1 unless you go out and come back with H1.
Cons: Fees is increased by 60-80% this yr for EAD+AP, so costly. Also if for any reason anyone's I-485 is denied then the period he/she used EAD will be out-of-status so applying I-485 again wont be easy with "out-of-status" but still possible, check with your attroney.
Note: But couple of my friends changed jobs using EAD+AP and got GC without any issue. so it depends case to case and your application and how USCIS process it.
H1:
no need to renew EAD+AP but i feel it is always better to have both H1 & EAD/AP unless you want to save money. H1 gives oppurtunityto reapply I-485 even if denied. I think Job shifting is possible with H1 transfer, but check with attroney. Also you need to do H1 renewal and to travel abroad you need H1 stamping while entering US again.

Hi,
My labor certification was filed in Dec. '06. Since its date of filing, the online case status was showing as "in process". However, on 07/20/07, last week, the status changed to "case denied".
1) What are the next steps?
2) Do I need to refile the labor certification. If yes, how soon can it be done?
3) Can it be filed for the same position or it needs to be filed for a different position?
4) Should I find a new employer to file for labor certification as my current employer could not get my labor certification approved or I should stick with this employer itself and file for a new labor certification?
Please help me out.

Like many of you, I'm also affected by this. My wait is almost
8 years now. I dont blame any body because I'm from a country
where beaurocracy and corruption is more than this country. I dont
blame anyone because it was my choice to come here and it was
my choice to apply for a GC. Nobody forced me. I've always a chance
to leave at my will. My strength is the belief that my gods will never
let me down.
Now I respectfully request everybody to update just the CIR updates
on this thread.
