U.S. citizens and lawful permanent residents (LPR) of the U.S. who are pre-approved, low-risk travelers are eligible to participate in the Global Entry Program, which allows expedited clearance upon arrival from international travel. The U.S. Customs and Border Protection (CBP) began their pilot system on June 6, 2009, in seven airport locations throughout the United States. Beginning August 24, 2009, the Global Entry Program will expand the program to include kiosks at 13 additional international U.S. airports including airports in Boston, Massachusetts; Dallas, Texas; Detroit, Michigan; Fort Lauderdale, Florida; Honolulu, Hawaii; Las Vegas, Nevada; N.J.; Orlando, Florida; Sanford, Florida; Philadelphia, Pennsylvania; San Juan, Puerto Rico; San Francisco, California, and Seattle, Washington.

Attorney did the work for me. But he asked for 2 photos for AP renewal. The EAD renewal generated a biometrics apppointment within 2 weeks (I am in CA)

I am currently on H1b applied for 485, LC Cleared, I140 Cleared.
I work for a company X but own another consulting company and I am a passive partner with a share of 49%. Another friend of mine who is also in the same boat as I am is another partner with 49% stake. My Sister who is a Green Card holder has 2% Stake and is an active partner.
I have not taken a single penny from the company in the last 2yrs we formed the company and we file a K1 every year. Even though the company makes profits/loss we are not taking the profit nor writing off the losses from our individual taxes, However both of us (I and my friend who are passive partners) end up doing most of the work such as
1. Signing the bank checks
2. Signing the USCIS documents for employees who are working for our company.(for I129, etc etc)
Does this mean that I am a clear candidate to be on INS Red alert/Radar?
I know that an H1b holder can have a company on H1B and cannot work for that company part time/full time precisely what I have been doing since I have never taken a pay check from the company however I never thought that this could have implications on the 485 approval.
Can some one answer my question. I guess I am more looking at some one like UnitedNations to answer.

Company A can not by law press any charges for the filing fees of H1B petition but they might go after you to pay for other costs in case you have agreed to pay for attorney fees.

I went to US on B1 and came back to india last week, I would like to apply H1 in the current year. Is there any cooling period to apply H1B once come back from US on B1 or Can I start the H1B process immediately.

So are these different from the finger prints that we take for EAD? For people who got their priority date current, do they ask for a separate finger prints again? Does anyone can shed some light on this?

i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.
i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?
also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

Once USICS receives your app they will send out a document for finger printing.You should take a infopass appt and go to a local USCIS office to be finger printed.
The time frame to receive this document ranges anywhere from a month to 2 or more.

To my understanding, if one is maxing out 6 years of H-1B visa on Nov 30, 2009 and doesn't have a way of extending to the 7th year H-1B.Then he has to stay physically outside of USA for 1 year.
1.Does 1 year stay have to be in the home country only?
2.Can one come and visit USA for a month[June 2010] or so between Nov30,09 and Nov 30,2010.[Eg: Conference, interview]?
3.If answer is yes to 2, would one have to stay for another 1 year away from July 2010? or they can come back to US during Dec 2010, if they have a new H-1B job?
Inputs appreciated.

you can use OCT 02 EB3, file I-140, after it is approved you can port the Oct 02 PD for the EB2 application too. This way you will be current as soon as I-140 is approved, guaranteeed.

I think you should get it extended. Its a back up for your EAD if you are working in the same company. It does not affect your current 485 process.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.
