Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....

For years now, Congress has debated whether to pass the DREAM Act. The DREAM Act would give a future to undocumented youth through a conditional path to citizenship and it would have legalized people like Tam Ngoc Tran who died earlier this week in a tragic car accident.
Tam was a native of Garden Grove (http://blogs.ocweekly.com/navelgazing/illegals-illegals-illegals/tam-tran-garden-grove-native-a/), California, born in Germany to Vietnamese refugees. She was pursuing a doctorate at Brown University (http://www.boston.com/bostonglobe/obituaries/articles/2010/05/17/tam_tran_brown_student_fought_for_immigrant_rights/). She was a graduate of UCLA, and she was a tireless DREAM Act Advocate, having testified before Congress in favor of its passage.
Tam, herself was undocumented and found removable by an immigration judge who denied her and her family political asylum. On appeal, the Board of Immigration Appeals found that the family could not return to Vietnam because of fear of political persecution, so the US could not remove the family to Vietnam. Having been born in Germany, the government sought to remove her to her birthplace, yet Germany refused to grant her entry. Tam was stateless. The only home she knew was the United States.
This tragic accident took the life of another passenger, a fellow UCLA graduate and DREAM Act activist, Cinthya Felix. Fong & Chun, LLP offers condolences to the families of both Tam and Cinthya. --ecf

President Obama will send up to 1,200 National Guard troops to the Southwest border and increase spending on law enforcement, yielding to demands from both Republican and Democratic lawmakers there that border security be tightened, administration officials said.

Homeland Security officials said that the troops would provide support to law enforcement officers already working along the border by helping observe and monitor traffic between official crossing points, and would help analyze trafficking patterns in hopes of intercepting illegal drug shipments. They performed similar tasks in an earlier deployment along the border from 2006 to 2008, when they also assisted with road and fence construction. The troops have not been involved directly in intercepting border crossers.
In addition to the soldiers, the White House said it would request $500 million in supplemental funds to pay for more federal agents, prosecutors, investigators and technology at the border.
Homeland Security officials have said that they have significantly increased border security efforts since Mr. Obama took office. Homeland Security Secretary Janet Napolitano, a former governor of Arizona, said last month that the border was “as secure now as it has ever been,” though she conceded there was room for improvement. My 485 got approved 2 months back. There was an RFE for my wife and by the time I answered it, the visa numbers were over. Now I am planning to change my job. I know its good to wait for at least 6 months before you switch over, but I don't have that option. Can there be any issues with my wife's application?

My case was filed in EB-3 category (August 2003). I completed a doctorate in 2007. I am thinking of filing in EB-1 and EB-2. Can anyone help me with links for preparing these applications and some dos and donts? Also is there any way to recapture my earlier PD (Aug 2003) for the current filing? Thanks for your help.

this is my understanding but a lawyer answer but you should consult a lawyer
Since you have started your GC process and shown your intent to immigrate your F1 will be denied.
H1 is a dual intent visa ( you enter as non immigrant but U can immigrate on it) and hence application of GC has no implication on it.
Again I am not a lawyer so consult one.

If the position you are being sponsored is 50% or more different than the position under which you have gained your experience, then experience gained in the same company can be counted. Your attorney somehow has to show that the postion you have now is more than 50% different (duties etc) than the new one. This is a tricky one and you would need a GOOOOOOD attorney to do that.

Gurus, please help. Can anybody throw some light on why my LUD has changed on I-485. Could it be because of name clearance.
Name check cleared would not result in a lud. But if you get more luds in the next couple of days, which probebly means they are processing your case, you can say your name check is cleared, because they only start process your case after name check is cleared.
Is you PD current? If not, your case cann't be approved no matter how many luds.

You do not need to inform the company holding your H1 when doing a transfer.
I believe this year's quota is over - so if you do have a file a new H1 ( and if cap to non-cap is considered a new # ) , then you will have to wait till next year.
I'm not very aware of the process of transfer between cap and non-cap - the new company's attorney are another good source for your question - they should be able to help you out faster.

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.

I don't know about any of those lenses from personal experience, but for what it's worth, Bj�rn R�rslett rates the f/4 version at 2.5 out of 5 (on a D1x, which is similar in resolution to the D70), and doesn't have much praise for its image quality. I'd guess that the f/4-5.6 versions, being newer designs, should be better.
