Hello,
My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

Send him a letter by certified mail and then dump the bloodsucker ! Noncompete agreements are very dubious in the first place so I doublt the employer would try to reclaim the loss.
Also you can get a free initial consultation from a licensed lawyer, there are plenty of options here. At most he would charge you something around $200

Hi,
I am on H1 visa. 485 pending, and have EAD. However the 1 yr period of EAD is nearing, the EAD expiry date is Aug 20. We have already applied for EAD renewal and have recieved 'notice of receipt' for the application.
My question is can I use EAD and change job while EAD renewail is in process? The problem is that the current employer may be closing this dept in few weeks and therefore, I will be losing this job. I would like to know if i can join a new job while EAD renewal is in progress.
Any suggestions please
thanks
You can, for the duration of your current EAD. If you get your new EAD before that, then everything is fine. If not, you might have to stop working on the expiry date of your current EAD till you get the new one.

How your husband file H1B for you ?
Did he own a company ?.
Did he file your H1B using desi body shops? without interview or knowing you ?!!!!!!!!!!!!!!!!
Are you start working for the company?
Your H1B start date is October 1, 2009.
Your H1B approval notice does not have I-94 attached, because you are not applied H1B while in USA. So you need to go back to home country to get visa stamped and start working in H1B ASAP.
Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.
But when he filed my h1b i was in india.
i came to us on June 2009 on H4 visa.
can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.
thanks,
subri.

I entered US with a tourist visa in California. Months later, I got married to a US citizen in Austin,Texas. Me and my husband were apprehensive at first to get an immigration lawyer to process my visa but we realized the process of obtaining a visa was not as straight forward as we thought.
We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.
My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?
thank you
Post it in the "Ask a Lawyer for FREE" section. Some attorneys read that and if any interested will either reply or PM you i guess. good luck.

Yes, after you get your EAD card You can go to near by SSN office and apply SSN for your spouse. I just did that today and they said she will get card in 10 days. You need a SSN to join any office.

And if I get my green card through the UAFA (hopefully it will pass in 2010 or 2011) then thats one less person in the EB2 queue. Thanks for posting this!
Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. My friend Chuck Kuck, president of the American Immigration Lawyers Association, has posted his written statement here. Thanks to reader...
