The International Labor Organization (ILO) of the U.N. kicked off a four-day regional meeting in Stockholm Tuesday aimed at improving working conditions worldwide.
"Atlanta Labor Certification (ALC) and the situation in Cambodia remain the most pressing issues we are facing today," Swedish Labor Minister Nils Freivalds, the meeting's chairman, told participants. The participants are expected to endorse The “Missing Application Statue”, a memorial aims at educating the public worldwide about the Atlanta LC tragedy of August 07, when hundreds of thousands of applicants and their families were practically prohibited from applying to permanent residency and gaining labor portability. Those victims might have to wait for several years to get another chance. Atlanta shelved their LC applications for times ranging from 2 months to 2 years while the LC applicants at Chicago where getting results in 2-8 days.
“This statue is created to remind us of what has happened and what could occur if we forget the past. May the tens of thousands of applicants in Atlanta and their families always have a place in our hearts. And may their suffering not be in vain.” said Freivals.
This is the second time a UN agency interfere in an issue related to Atlanta Labor Certification. The first time was in May 2007 when the General Assembly voted to prevent the usage of the term “Atlanta Processing” referring to extremely slow and inefficient systems. The term was considered very cruel and inconsiderate toward the victims and their families.

On June 9, 2009, U.S. Department of Homeland Security (DHS) Secretary Janet Napolitano granted deferred action for two years to widows and widowers of U.S. citizens (and their unmarried children under 18 years old) who reside in the United States, and who were married for less than two years before their spouse’s death. Deferred action is a short-term act of prosecutorial discretion that suspends removal proceedings against an individual or group of individuals for a specific timeframe. The action is temporary and it will not resolve an individual’s underlying immigration status.
In addition to the deferred action, U.S. Citizenship and Immigration Services (USCIS) will suspend all adjudications of visa petitions and adjustment applications filed by widow(er)s where the only reason for reassessment of immigration status was the death of a U.S. citizen spouse before the second anniversary of the marriage. Further, U.S. Immigration and Customs Enforcement (ICE) will now defer initiating or continuing removal proceedings, or executing final orders of removal against qualified widow(er)s and their eligible children.
Secretary Napolitano states that the deferred action is a “common-sense and practical” solution that will grant “these individuals and their children an opportunity to stay in the country that has become their home while their legal status is resolved.”

So that means in my case, if some company agrees to file H1 for me, i will not be counted towards quota. Please let me know if my understanding is correct?
In the mean time my company's immigration department is also checking about this. will update whenever i get any response.

My PD is Dec 2004 EB2 for a future jon offer. I won't be able to start the job until July 2008 as I am still completing my fellowship. I have read somewhere in the past that I can file I485 for this future job as the dates have now become current. Can anyone confirm this and any idea what is the general recommendation for the duration that I have to stay with this employer once I start the job.
Minimum 6 month is considered a safe period.

I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.

I used the AR-11 form for the change of my address. I did it online. Also, while changing there is an option to change the address for any pending petition. In my case it is the I-485, which I changed.
My question is, how to verify if the address has actually changed in the system at USCIS. I checked my case status online and did not see any LUD's.
Please let me know if anyone of you have done the change of address and share your experience.

I was recently invited by a fellow worker, who is spanish ( I am desi ) - to an event organized by CHIRLA - the Los angeles (http://www.chirla.org/) - Colation of Humane Immigrant Rights of Los Angeles. It was a fund raiser - with Fun, a few bigwigs were also present and people were paying $100/person to enter. Although this was a glitzy function with girls in gowns and guys dressed up in party wear..with drinks and lights etc..the gathering was all spanish, and there were many families as well as lot of college kind / working youth were there...
This gave me an idea about IV and how IV is now a known organization, both within the immigrant community and now also in the USCIS as well as with lawmakers and AILA, how about organizing a fund raiser in DC - invite AILA, maybe Rajiv Khanna and maybe someone from the CIS community. It can be a good platform both for IV to make an impact as well as generating funds and interest in what IV is doing.
Maybe have these people spend 10 minutes each on the stage, with some good grub (sponsors can be approached) and maybe light drinks (not sure) - but all in all a nice atmosphere and a forum to help us not fight with USCIS but to make them understand and appreciate our pain.
I know we have done this in college and all, but a 10 minute short play by the Immigrant community (DESIS) - should be fun as well as an eye opener to these guys..

My labour was filed for a software engineer position (java, udb, etc) 3 years ago. Over that time, my role has changed to a project manager. Infact I don't do any coding anymore. If I invoke AC21 after 180 days, can I switch to a Project Manager position?

These are two different skills, unless you can manage to have job description of your new job to be the same as in LC. Or you can leave it the way it is, provided your employer intends to hire you as a software engineer upon approval of LC, and you intend to accept it. In the meantime, do whatever you want - project management or anything unrelated.

There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,
