Hi,
Applied for EAD renewal on 6/11/2008. Should I get it for 2 years or 1 year.
My understanding is everything that gets processed after 6/30/2008, will be for 2 years.
My PD is 6/12/2006, EB2 - which is not current right now, and I don't expect it to be current, until my I-765 gets processed (Well if it becomes current I guess I don't need 2 years :) )
Thanks for any comments/thoughts!

Get it Notarized with photo and send the document.There are standard formats available.
If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.
So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

I had applied for my EAD , AOS on July 30th. I did received my EAD and I-485 receipts.But my wife never received hers, on contacting USCIS I came to know they had my address wrong .Receipts & EAD are delivered to my neighbours mail box,it seems they trashed all documents, I don't know what else I can do.

Everybody please post the names of attorneys who are easy / not easy, safe / not safe to deal with. People can post the names of the attorneys and a brief description (without specifics) about the problems / happy endings, they encountered. This could become an excellent review post for immigration lawyers. we could also maybe put 3 or 4 criteria to score them from 1 to 4. for eg:-
availability to answer questions
timely filing
acurate filing (with all documents)
current with legal provisions and latest changes
overall easiness to work with
cost
etc etc
Experts pls join in to fix the scoring pattern. We need to know the crooks and the good samaritarians out there.

Hi All,
Here is my question.
I was working for employer A.I left employer A on Nov 15 , I received my last paycheck from employer on Nov 22, 2007.
I know my employer A did not revoke / cancel my H1b.
I accepted offer from employer B on Nov 20.I came in communication with employer B lawyers on Nov 23.I am based in one state and work
in another state.Lawyer got all the documents from me on Nov 25,Then she said , we will have to get prevailing wages from two states , and she
send the request for them.We received prevailing wages from states on Dec 11.Then she sent my H1b transfer petetion to USCIS on Dec 14.I received
the receipt from USCIS on Dec 18.
Will my H1b get transferred , or will I have any issues.

PD � Dec 2007.
H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.
I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.
Questions:
1. Will I need a new H1-B? If so, for how many years will I get it?
2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).
However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

While travelling on H4, IF she gets her H1 Approval she can get the same stamped in the overseas and travel whenever even after oct 1, No issue with that.
Now on the other hand if she travels back on H4 after oct 1 which is the start date of H1 that may override the H1(Not sure consult appropriate attorney)

I have already sent my 485 application

In the field I94# and expiration I entered I 94 number which is on the white card on the passport and it is the same as the number on my renewed h1 papers.However I entered expiry date from the i94 on the passport,which is oct06 instead of the 010 date in the renewal.
will that be a problem..? CAN I CORRECT IT AFTER I get the reciept no or will thay be able to verify with the latest h1 paper that i94 is valid

I joined my present company in June 2004 on CPT, missed the summer graduation so applied for the spring graduation. Got my MS diploma in Dec 2004 (non thesis). Went on H1 in Oct 2004. Applied for GC in Feb 06 as EB2 and I got it without any issues. I know another friend of mine who joined with me in June 2004. He actually took classes later to finish his MS and finally graduated in December 2005 and he too got his Eb2 approved. The GC is for future job and not the current one so according to me it should be fine.

That could be things like
NOID - Notice of intend to Deny.
RFE - Request for evidence.
For I-140 USCIS does not update the online status properly. For both of my EB3 and EB2 I-140s still the case status says they received the application and processing!
Wait for the document that they sent.

My attorney by mistake has applied for my ead renewal 10 days before the 120 time frame. I was supposed to send my application to USCIS by June 20th but my attorney sent it today and did this by mistake. can the gurus please explain me my options. i would hate to miss the line for being diligent. do they reject my application and if so will they send it back. can i apply a new app before i get this application back or do i have to wait till it comes back (if it comes back). what other negative implications should i be worried about.
