1. Is it mandatory for USCIS to send the NOID/RFE for employer revoked I-140? (if the candidate is invoked AC21)--- There is no guarantee. There has been many cases USCIS denied 485 without sending NOID
2. Can we retain the I-140 after submission of new employer's offer letter and pay stub?
---Previous employer can still revoke 140, but you are safe becoz of AC21 provisions
3. If previous employer revokes I-140, when will the USCIS send NOID/RFE?
your guess is as good as mine
4. When will the employee know about the revocation in general (how many days)?
---after you receive RFE? or you can check online status.
5. If one re-joins the previous employer after two months, can the employer cancel the revocation of I-140 or re-validate the I-140?
once revoked its gone
I would really appreciate for your valuable suggetions and answers.
Regards and thanks for your help...

My wife's H1 got approved & it is valid from October Ist. When she went to Social Security Office today 9/30 - they denied saying they can't pull up her information in their system (from INS) & hence they can't issue the SSN.
She was carrying her I-797 approval (along with I-94).
Anyone else faced a similar situation ? Any suggestions.

one of the stories posted on the thread about lawyer negligence.
[B]Hi ,
One of my cousin was working for a consultant firm from 5.5years and their company lawyer filed his labor in 2005.Whenever he called his lawyer for status checking, lawyer always replied that his case is pending. When he checked his case status online last week,he came to know that his case was closed.Reason was lawyer did not respond to notices from uscis in october and november 2006.And whenver my cousin emailed his lawyer, lawyer always responded only over phone and not by emails. So can anyone suggest,as to how to go about this case?Does he need to sue his employer or lawyer for misleading? Is this the master trick of employer or lawyer? And now no option for substituted labor too!Can his case be reopened again or will he have to file his labor again?

Ok , just got off the phone with my lawyer. He says we can not file a I485 because the priority date is not current. EB3 is showing 01OCT01 and we can only file that form when the bulletin is showing April2002. He says we are not eligible for that...And then he said "if the date was current, you would be in Turkey for consular processing and will not need file"

I just realized that I didn't explain what HDR is- The idea is to take a series of more or less 10 photos with different shuttle speeds and then composite them into one unique image that will capture all the light effect due of the high range of the natural light.
The exposure range of a modern digital camera is about 5 stops, or a range of 32 times more light in the lighter than in the darkest region. If you take one shot at -2 and one at +2, you've extended the range by 4 stops in total. This will give 9 stops, 512 times more light in the lightest part than in the darkest part. This is A LOT of range. You could extend this to three stops either direction, and get 11 stops range, which is about 2000 times more light in the lightest region than in the darkest.
If we assume that you start out at 1/125 f=8, then the 3 stops would give you:
1/15 f=8 +3
1/125 f=8 0
1/1000 f=8 -3
1/15 f=8 is about the right for a relativley dimly lit indoors scene, 1/1000 f=8 is good for outdoors.
I'm not sure exactly what you're after in this, but I would think that would be sufficient for most purposes. If it's not, can you explain under what circumstances you're (planning on) taking these photos?
Also, note that the range for a normal PC's display is about 10 bits, or 1024 levels (in the DA converter that converts the digital value to a "light value" on the way to becoming a bunch of electrons hitting a flourescent media [Plasma panel/CRT displays], or on the way to being a LCD-cel [in a LCD panel]l set to a certain level of darkness).

I'm in the US working on L1 visa, though I have an expired visa, I have I94 valid until Jun 2008 which makes me legal to work here until Jun 2008. Now, I'm planning to travel to India, Do I need transit visa in France if I travel via france.
What on earth makes you legal to work with an expired Visa?

This is great news. I think the lawsuit was made to coincide with the conference between USCIS and DOS with members of Congress. This is a total game changer.
Thanks to the mighty and courageous Chineese gentlemen who finally stood up!!!

What are the supporting docs along with AP? I will be travelling by Emirates via Dubai in Novemeber.
TIA
The AP should be accompanied by employer's letter that proves your support,i .e.It is a simple letter which states that the employer supports your I485.
Please also carry few recent paystubs and copies of all h1,if they are not stamped in the passport. This was asked at POE in IAD(Washington Dulles International Airport).

upto 6 months. they send out a letter as soon as you apply stating they have recvd yur app and working on it. I had applied for a Name correction. They refused after a couple of weeks itself and asked me to get it corrected in the visa consulate of the home country. When I went for stamping in chennai I pointed out error and the new stamp had the right name. Consult your attorney.

Do I still need a copy of I-140 if I have I-797 extended for 3 years from the existing employer?
If you already have your h1 extended for 3 years then you can get those 3 years with employer 2. Consult a lawyer though, when you actually switch jobs.

Applied i140 and 485 on July 2nd and yesterday my i140 got approved. So I guess no need for premium processing now as the process is moving faster.
That was just a stroke of luck. There are 140s pending for several months in both NSC and TSC.
Occasionally an isolated case sneaks in.
Like someone posted this morning that he received an ead although the lawyer says he never applied for one!
