My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?

I am trying to understand the I-485 process and unfortunately don't have a lawyer to ask questions.
Can someone please explain why copies of the passport (showing biographical data) are required? Which form asks for them - I did not find anything in I-485. That form only asks for a copy of the visa, if issued within the last year.

I agree that an error in name order on an EAD is not likely to cause any major problems. However, You can apply for a replacement card by filing another I-765. If the error on the EAD is due to a USCIS mistake, no fee is required. However, if you caused the error by providing incorrect information, then you will have to pay the full $340 filing fee again.

I have returned from India on AP three days ago. Immigration officer just asked questions on my employment, but he did not ask for proof. If you have multiple APs you should submit all of them for stamping. Thats it!
I got AP..and H1B till 09..I am hoping to reenter using AP while comming back from india..Apart from AP do I require anything else. like employement letter to reenter the contry??..

Also here is my next question. When my H1B extension is pending, can I change my employer? Should the new employer wait for my H1B that will be renewed or does the new employer apply for a fresh H1B renewal? I guess he cannot do this because I will out of status for 7 months and this might turn out to be illegal. Someone plsssssssss answer my questions!

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?

I checked the German Mission in the US website and there I-797 is not mentioned among the documents permissible as exception for Transit Visa. Best is to call the German Mission and confirm. When I spoke to them it looked that they were already aware of this confusion and gave me a definitive answer that I didn't need the transit visa.

I work for Company A. My labor and I-140 has been approved with Company A. I am in my 9th year H1 extn.
I plan to join Company B using H1 transfer (AC21) and they also help me continue my I-485 by proving similarity of job.
There is a high likelihood that Company A will revoke my I-140 once I tell them I am leaving to join company B. I am safe with B because H1 transfer and I-485 has been done prior to I-140 revocation.
However, if I were to join a third Company C using H1 transfer (AC21). Can I do it and also keep my I-485 pending? Please advise.

I had 3 of my co-workers in IV and they are no longer here. What ever i did before for IV is with the help of the university students and most of them i know left after their graduation or ready to leave in the next few months.
As always there are other members who are in IV and they do not want to participate in the IV activities. All they want is to get the information from IV forums.

In that case, your L-1 is due to expire in September. Your employer can file an extension petition. Once approved, you will get a new form I-797 with a I-94 (valid for the extended period). The new I-94 will allow you to live in the US for that specific period. If you want to travel abroad, you have to get the new visa stamped on your passport.

Simply going by the voting standpoint, I think between now and 08 elections, politicians will have little incentive do anything about our case (i.e., legal immigration) realistically. I'm not sure whether we represent a % of voter population that's high enough for them to place our case on their priority list. Moreover, giving us GC now will probably benefit them (in terms of votes) at least after 5.5 years once the GC holders are citizens and hence able to vote.
Just my thought for what its worth.

Where does that put us considering the house bill didn't even make it to markup today?
I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.
