I am an American who has been a french man for the past 3 1/2 years. We met in college which he had a student visa to attend. Afterwards we moved together for him to get a job. At that time he still had a valid student visa and an OPT. We decided to move to France, but now after a year, I am ready to go home. We were PACSed (like a civil union) in France, but it is not valid in the states. I have read many things saying my boyfriend would need an H1B visa to work and stay. I have spent the past 2 days searching for companies that might sponsor him, which I have found none. He is a college graduate of East Tennessee State University, with a bachelor degree in business management. I have talked to people that all say to just get married but being 22 and 24 years old we want to wait and I don't want to say we got married for him to live in the states. My question is what are really his options? I would love to come back to the states ASAP but I want him there too. Are there lists of companies hiring and sponsoring H1B visas? Is it permitted to enter the US on a tourist visa and while you are here, can you start working since H1B approval has been received? The reason I ask is that my some time is needed to set up an apartment, get SSN etc. and it would be easier to come a little early while H1B is being processed. Can you get the H1B stamped in the passport later in Canada? Thanks in advance!

On June 17, 2009, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested.
Received RFE through mail, It says G-325 form missing. Don't know how will that miss?
Our EB3 PD is JUL-06 then why RFE now? Shouid I reply RFE by just G-325 to USCIS or whole I-485 package again?

What if, only H4 holder (AOS pending) returns to USA using valid (till Dec' 09) H4 stamping ? Do they (at POE) come to know that spouse's 485 has been approved ?
H1 holder (485 approved) will return afer couple of days.
Urgent please help by giving your suggestions/opinions/experiences.

Hi
Since I got electronic refund to my tax rebate and have SSN for all family members, I was expecting Tax refund (stimulus) to be deposited in my bank accoung this week. This was big announcement in the last week.
But I dont see any rebate deposited in my account?
Does any of you have received such rebates?
Is there any contacts numbers where we can approach if we did not received Stimulus rebate al though we filed electronically?

I have started a thread with similar message. Giving GCs to us means atleast another 10,000 home purchases = $3 billion. A few people here supported that idea, a few vehemently opposed and few was kind of neutral.
Worth pursuing in my opinion.
I am suggesting we should write to White House and to the Ben Bernanke in Mass and draw their attention towards a million people waiting for their green cards, logically they should have already got it(10 years waiting is illogical) but if USCIS use Visa recapture these people can get green cards and green cards to these people means a million new house buyers in the market new cars buyers etc etc. Everybody is going to get green card one day, why not now..That will help bail out the housing market. I'm sure it'll strike a cord with the lawmakers as it will benefit them politically....

That helps somehow I was under impression that once you invoke AC21 you have to use EAD. I prefer to be on H1 as long as possible till GC come.

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.

the second charge of "false statement" to the officer is? That will look negatively on the character of the applicant.
In general traffic citations are minor misdemeanours. Not sure about fishing. But the second charge IMO is a bit serious.

AFAIK, everybody needs to fill out form I-9.

I'm going to use EAD under 1099 as an independent contractor, My employer asked me to fill only w-9 form when i joined the company.
My employer doesnt know whether i should fill I-9 form (employment verification eligibility) or not?
Anybody have such experiences to share?

lawyers do this all the time. I guess USCIS is fine with it.
