Hi,
Somewhat same situation. Can I travel after filing 485, I have not got the receipt yet. Although my H1B visa stamp is still valid.

I entered US with a tourist visa in California. Months later, I got married to a US citizen in Austin,Texas. Me and my husband were apprehensive at first to get an immigration lawyer to process my visa but we realized the process of obtaining a visa was not as straight forward as we thought.
We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.
My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?

My PD is Dec 2004 EB2 for a future jon offer. I won't be able to start the job until July 2008 as I am still completing my fellowship. I have read somewhere in the past that I can file I485 for this future job as the dates have now become current. Put yourself in the USCIS officer's shoes and think how these 2 jobs are similar? The only similarity between both of them is these 2 jobs are in IT. That's it.

You need to find out what type of visa etc etc I don't think she is giving you all the details. You can appeal on anything unless you have broken the law.

I'm in same boat, upgraded to PP on June 1. your new status of I140 will be "We received request for PP".
For H1's Ext its the same receipt number . I think for 140 it will be the same .I subscribed to the notification of case status and i received an update oon the case saying the Premium processing requested for the petition

Bush did not mention a single word about legal immigration. He was referring to foreign (limit/read that as Mexican) workers and putting in place programs to stem the flow of additional undocumented ones. He spoke just over a minute and there was not a bit to be gleeful about for legal immigrants.

These tough times for folks like me have been there for the past several years. Now, I am hoping the letters campaign does make an impact and get the much required good will.
As a side note, seems like the writers have sort of given up already on his last year of his presidency as the entire speech was rather mundane. In a troubled time for the entire country with the economy down, house market bust, recession looming, he chose to highlight the past and glorify to garner legacy.
Will it be a year of inaction? I hope not, lets us do our bit by supporting efforts of IV.

My H1-B was approved in octubre 2008, I would like to go to my home country but i don't have a visa to be able to come back.
Now my question is:
Having an approved H1-b is a warranty for me to get a visa to come back to the US.
Also carry your educational docuements. They asked me last time when I went to stamping for my H1B Extension, in Feb 09. People over their in the Embassies looking in all means to stop giving the VISAs. So be prepared with all the documents.

Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?
