Hi Members,
I am pretty new to the forum. I thought you must be helpful answering my questions because attorneys in my company provided are not helpful.
My attorneys filed Labor with the missing job information like in the allien job experience section. i saw the the current job start date is wrong then the job 2 is put with the wrong dates. Job 3 is not there. I got a audit as ******** is my attorney as special audit. when I contacted they said its electronically filed then can't change. They will take care in later stage.Then THE LABOR IS CERTIFIED. Now I see nothing has been taken care. they are filing I-140.
Now my question is if i get RFE in I-140 in future and I send the experience letters obviously which will be different date( as labor is approved with aliens wrong info in experince).
PLEASE members let me know the complication.. am getting really worried..Let me know what to do.

I applied on 7/26 for seventh year H1-B renewal and extension of stay. I concurrently filed I-539 for Extension of Stay for family. Six years of H-1 and related I-94 expired on 10/8 and since then I have been working under the 240 day grace period rule.
Here are some other facts:
- I have an approved I-140 filed and approved back in 2007
-I-485 was filed during the 2007 July-August wave
-I do have an EAD valid until November 2011 but I have never used it. I have always maintained my H-1 status.
-My wife also has an EAD that expires end of this week. I-765 Application to renew her EAD was filed more than 75 days ago for which we requested an expedite request. She has never worked before although her first EAD was approved three years ago.
My questions:
1. What happens if USCIS denies my employer's petition for H-1b extension? Will I be out of status immediately after? Does having an EAD provide me any insulation?
2. What about other people here those who are working on EAD? How are they maintaining their status? Are they required to file extension of stay application?
3. Do you think approval of my wife's EAD renewal is tied to the pending I-539?
4. What about my children? In the event my application for H-1 renewal is denied, will they be out of status immediately after? Are there any steps I can take to ensure this does not happen

These days with tons and tons of I-485 applications received every morning, how is USCIS gonna decide which one to process first?
If it's strictly on "first received, first processed" base, then it may well be that one guy with 3/07 PD date may have his application processed earlier (thus earlier AP and EAD) than one with 5/06 PD date. Simply because the 3/07 PD guy sent out the package much earlier than the 5/06 PD one.
Do I understand correctly?
Is this fair, though?

For my spouse's EAD Application, we are seeing continuous LUDs but no message change. Messages till says "case recived and prending". Where as for my EAD application it says "card production ordered".
What it could be? When do we need to contact USCIS on my spouse's EAD since it still says case received and pending?

Hello All,
I got my US green card in EB3-I category through consular processing after an interview in Montreal, Canada in 2004.
My PD is 29 March 2002. My family could not accompany me to the interview and hence they did not get their green cards at that time. I wanted to schedule an interview for them since 2008 and the Montreal Consulate informed me that my PD is not current. This is somewhat strange as I have already got my Green card in 2004. I have tried all options but everyone tells me that I have to wait till my PD becomes current. I am not a US citizen yet. The way EB3-I is going it will be easily another year till my PD becomes current. (The PD date has moved by 1 month in the last 6 months)
I will appreciate if anyone has any suggestions for me.

Fellows,
some body told me that if you are on H1B1 then you can not file for greencard. is it true?

What sort of "tricks" are you after.
I think it's fair to say that "learning to use the camera itself" is the easy part. Understanding of how to take good photos is a lifetime ambition for most of us... ;-)
To put it another way, there may well be small tricks like "if you set this up, you can press that button, and you've automatically set it ready for doing X". Which is great. But if you don't know the basic things like: composition, lighting/exposure and control of focus/depth of field, which are the basic photography concepts, then you're barking up the wrong tree fishing for tricks.
So, some tricks are "rule of thirds" and "blur out un-wanted background noise". But that's regardless of the camera you use.

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

One of my family member came to US on visitor visa a year ago. She was granted 6 months visa at the port of entry. After 6 month, she filed for another B1/B2 extension with USCIS and was granted another 6 month of stay. The 6 month extension is about to expire.
She had booked her tickets and got ready to leave but unfortunately she became seriously ill and currently is not in a condition to travel. She is going through medical treatment but because of the seriousness of the illness, it might take another couple of months before she is healthy enough to travel.
Now the question is can she apply for 2nd extension of visa based on medical ground. By law, can she even file for a 2nd extension given that she has already been in the country for about 12 months. I talked to an attorney and he said that she can file but likelihood of getting another extension is very low.
If another B1/B2 extension is not possible, is there any other kind of visa available for her to stay here while she is going through the medical treatment?
