Gurus,
There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.
On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.
Thanks in advance.

Hi Guys,
I don't know if this is already posted... Here is my situation...
I had applied for 485 in July with Future Employer in EB3.
After 6 months, I want to port the application to my existing employer. At that time, is it possible to convert the application from EB3 to EB2 using AC21 portability??
Any help is appreciated!!!
I dont think u can convert from EB3 to EB2 and AC21 are two different things.
AC21 is for chnaging employers after filing AOS and is pending for more than 180 days.

Immigration Visa Attorney Blog Has Just Posted the Following:
http://www.immigrationvisaattorneyblog.com/flag_CNMI.gifAll immigration law attorneys must deal with foreign countries, unique international legal issues, and some quaint interpretations of law. The lawyers at Los Angeles' Fong & Chun are no exception, and in fact, this recent change affects some of our clients who do business in or own businesses in the Commonwealth of the Northern Mariana Islands (CNMI).
On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by 101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. Isn't this esoterica fun? --jcf

Hello --
Do any of you know what the A# is on the I-485 / I-130 / I-765 etc is for people who have previously held an F-1 / OPT-related A#? I have seen previous forums stating that OPT A#s begin with a "1" which connotes an OPT status; however I am not clear whether we are supposed to use that same A# on our I-485 and other GC-related documents, or leave that space blank.
Sorry this is redundant but previous posts don't seem to clarify a definitive answer to this question. Many thanks in advance.

I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.
Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?
Thanks

My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .
From what I know, you can only have one 485 application pending at a timeeeeee. So your wife cannot file for 485 unless she withdraws the one filed under your labor.

One of my H1B friends went to Frankfurt for some work and expired US visa...The Germans gave him visa because the client is a very large bank in Germany..
I remember that to get the H1B restamped he went to Delhi after he was done in Frankfurt...
If your client in France is big enough and gives you a letter....most likely French would give you visa....They would ask for detailed itenerary...
Please contribute to IV...

The DREAM Act could come up for a cloture vote as early as this week, but faces tough opposition from Republicans -- including a few who, like McCain, previously supported the bill.
Some will likely vote against the DREAM Act citing timing. Senate Majority Leader Harry Reid (D-Nev.) plans to bring up the bill for a cloture vote as early as Wednesday, but all 42 Republican senators have said they would filibuster any bills not related to tax cuts.
As the Senate struggles to come to agreement on the tax cuts and other issues, the DREAM Act could lose its few Republican supporters. Sen. Richard Lugar (R-Ind.), a co-sponsor of the DREAM Act, would vote against the bill if it came up this week, spokesman Mark Helmke said.
"You have to handle the spending bills, tax legislation and START first," Helmke said. "If we get those three things, he's willing to stay in and take up the DREAM Act."
http://www.huffingtonpost.com/2010/12/06/mccain-shoots-down-dream-_n_792809.html
Others Republican senators oppose the bill on its substance, even those who supported previous iterations of the bill. McCain now supports increased border enforcement and argues the border should be secured before the Senate can take up immigration issues such as the DREAM Act. Buchanan, his spokeswoman, attributed McCain's change in position to the increase in drug cartel violence in Mexico near the United States border.
Sen. Orrin Hatch (R-Utah) was an original sponsor of the bill in 2001. Earlier in the year, he seemed supportive of the DREAM Act when he was asked about the bill at a town hall meeting.

LUD means basically nothing.
I got FP done, got EAD and got Ap by October 2007. I have 3 LUDs each on mine and my wife's 485 since 01/04/2008.I just called TSC and the IO said no change in the case.

Yes atmosphere is not good for time being for any immigration bill. Let's wait formetime otherwise we will misfire.

I don't think leave of absence nullify employer employee relationship. I checked this with my HR too when I was waiting for my EAD to be renewed. HR clearly told me that the only option was to terminate my employment in case my EAD was not renewed in time, and they would have opened the position and rehire me after receiving the physical EAD.
However, this is my personal opinion based on my personal experience.
